By accessing or using DaySponsor.org ("the Service"), operated by DaySponsor ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
DaySponsor is a fundraising platform that enables organizations to run campaigns and collect donations. The Service facilitates connections between donors and fundraising campaigns, and processes payments through third-party payment processors (such as Stripe). Organizations and campaign organizers are responsible for the accuracy of their campaign content and for lawful use of the Service; we do not endorse any particular campaign or beneficiary.
To use certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Donations made through the Service are processed by Stripe (or another processor we designate). Payment processing, including identity verification for connected accounts where applicable, is subject to the processor's terms and policies. All donations are final and non-refundable unless otherwise required by law or as specified in a particular campaign. By making a donation, you represent that you are authorized to use the payment method provided and that the donation is not made for an unlawful purpose. We reserve the right to refuse or cancel any donation at our discretion.

You agree to comply with all applicable laws and regulations when using the Service, including laws relating to fundraising, charitable solicitation, taxes, anti-money laundering, and sanctions. The Service may not be available in all jurisdictions. By using the Service, you represent that you are not located in, ordinarily resident in, or using the Service on behalf of any person or entity that is subject to applicable trade or economic sanctions, and you will not use the Service to violate or circumvent U.S. or other applicable sanctions, embargoes, or export restrictions.
We may monitor, review, investigate, and moderate use of the Service as permitted by law and our policies. We may take any action we deem appropriate, including without limitation: suspending or terminating access to accounts; suspending, removing, or hiding campaigns or other content; refusing, canceling, or reversing transactions; placing holds on or delaying payouts; and cooperating with payment processors, law enforcement, regulators, or other authorities. Such actions may be taken with or without prior notice when we believe they are necessary to comply with law, payment network or processor rules, protect users or the public, or reduce fraud or abuse. You agree that we may report activity to appropriate authorities when required or when we believe reporting is appropriate.
The Service and its original content, features, and functionality are owned by DaySponsor and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYSPONSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless DaySponsor, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, or expenses arising from your use of the Service or violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive (e.g., disclaimers, limitations of liability, indemnification).
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
